It can be confusing to know what your and your child’s rights are when your child has an Individualized Education Plan (IEP) and is being disciplined at school. There are several important tips to keep in mind:
- Children with disabilities who have IEPs can be disciplined, but they have additional protections.
- Each school district’s Code of Conduct determines what children can be disciplined for. It is important to have access to a written or digital copy.
- Disciplinary actions of less than ten cumulative days are handled differently than those over ten cumulative days.
- Disciplinary action is related to whether or not the behavior was a manifestation of your child’s disability
- Special circumstances apply to disciplinary action.
